The Supreme Court on Monday barred investigating agencies from re-arresting an accused independently after an initial arrest is declared illegal for violating Article 22(1).
A bench mandated that police must obtain prior judicial permission from a jurisdictional magistrate and secure an immediate superior officer's endorsement before any fresh arrest.
The court directed that the investigation must be transferred to a new officer while a departmental inquiry is initiated against the erring personnel.
