The Allahabad High Court ruled that doctors pursuing subsidised postgraduate medical education at government institutions cannot evade their mandatory two-year government service bond.
The bench emphasized that administrative delays in providing a posting do not extinguish bond obligations, which protect patients' right to life and ensure hospital staffing.
The court directed the state to conduct fresh counselling for petitioner Dr. Aparupa Sen Gupta within four weeks and adjust her 89 days served as a senior resident.
