Supreme Court Mandates Immediate Release for Unlawful Arrests

The Supreme Court ruled that arrested individuals denied grounds of arrest and legal counsel under Article 22(1) are entitled to immediate release.

A Bench headed by Justice Ujjal Bhuyan emphasized that Article 22(1) is a mandatory constitutional safeguard that applies across all criminal and special enactments.

The court directed that any subsequent police re-arrest must be preceded by specific Sanction and recorded reasons from the concerned Magistrate.
