The Bombay High Court refused to discharge applicant Vishal Ingle, holding that Section 75 of the Bharatiya Nyay Sanhita applies when a complainant is a transgender identifying as a woman.
Justice Mehroz Pathan noted that the complainant underwent hormone therapy and alleged assault and outraging of modesty after a promise of marriage.
The court also ruled that the lack of a certificate of identity under the Transgender Persons Act at the time of the offence does not bar legal action.
